Could the Dismissal of Pikoli Be Constitutional Corruption?

8th December 2008

The dismissal of Vusi Pikoli today once again demands only one honest question:

WHY?

South Africa needs to know the truth. Why was Pikoli suspended by former President Mbeki and why has he now been dismissed by President Motlanthe?

"Mbeki's explanation of an alleged breakdown in relations between Pikoli and Justice Minister Bridgette Mabandla is legal nonsense as there is no legal relationship between the National Director of Prosecution and the Minister of Justice, because the directorate is independent," said Koos van der Merwe MP, the IFP's Justice Spokesperson.

President Motlanthe today cited no real reason for Vusi Pikoli's dismissal, merely stating that it would be "illogical" for Pikoli to return to office.

However, the special investigation led by Dr Frene Ginwala found that several of the allegations levelled against Advocate Pikoli were baseless and she further insisted that there was no irretrievable breakdown in the relationship between the minister and Advocate Pikoli.

"This then begs the question: what or who is really behind the dismissal of Pikoli? It can only be Pikoli's principled refusal to obey Luthuli House's orders that cost him his job. If this is true, it is political corruption and clear proof that the ANC will corrupt the Constitution to protect its own interests," concluded van der Merwe.
