IFP Calls On JSC To Investigate Reckless Judge

The Inkatha Freedom Party's Spokesperson on Justice, Mr Koos van der Merwe MP, today called for judge N Poshwa to be reported to the Judicial Service Commission for what he called "gross incompetence".

This follows the slamming of judge Poshwa by the Supreme Court of Appeal after judge Poshwa had granted bail of R1 000-00 each to two persons who had readily admitted to be the culprits; were charged with murder, attempted murder and robbery with aggravating circumstances; one accused who according to evidence had a history of aggressive behaviour and appeared to display no remorse, and both accused had no fixed address.

Van der Merwe said: "Poshwa displayed a complete disregard for justice. He was reckless and ignored material facts. The fact that a full bench of the Supreme Court of Appeal slammed his decision to grant bail is sufficient evidence to be placed before the Judicial Service Commission to charge Poshwa. There is no room for such incompetent judges on our bench and the sad result they accomplish, is to cast suspicion on other judges who perform their judicial functions meticulously."
