Motion For Establishment Of Ad Hoc Committee To Investigate Trumped-up Charges And Legal Process Instituted Against The Minister Of Finance And Two Others, Which Were Subsequently Withdrawn By Head Of The NPA, Advocate Shaun Abrahams

Draft Resolution (Hon. M Hlengwa, MP[IFP]): That the House –

1) Notes-
a) That the Minister of Finance, The Honourable Pravin Gordhan and two others were the victims of spurious and vexatious legal action instituted two weeks ago with great pomp, ceremony and indignation by the head of the NPA, Adv. Shaun Abrahams;

b) That said legal action was withdrawn yesterday by the same Adv. Shaun Abrahams, who effectively had taken himself on review and now could find found no merit in his institution of legal action against the Minister of Finance and Two others;

c) That South Africa has suffered grave economic loss in the amount of Billions of rand’s as a result of such spurious charges being laid against the Minister by the Head of the National Prosecuting Authority;

2) Establishes an ad hoc committee in terms of Rule 253(1)(a):
a) Hold Adv. Shaun Abrahams to a full account of his decision to institute legal action against the Minister of Finance and two others;
b) Determine Adv. Abrahams fitness to hold office as Head of the National Prosecuting Authority and as Adv. Of the High Court of South Africa;
c) Determine whether or not the institution of said charges against the Minister of Finance, were politically motivated and if so, the identities of the parties involved in such deceit;
d) Make recommendations where applicable;
e) Exercise those powers as set out in Rule 167 of the National Assembly that are necessary to enable it to carry out its task;
f) Consist of 11 members as follows: African National Congress 6, Democratic Alliance 2, Economic Freedom Fighters 1and other parties 2; and
g) Report to this House by the 8th December 2016.
